Felony Lewdness charges dismissed against client in Passaic County
Our client was charged with Lewdness, Endangering the Welfare of a Child and Theft in Passaic County. This was another one of those fun cases that make you happy to be a defense lawyer. It helps that the client and his family were nice people – oh yeah, and the client was getting completely railroaded! The client was performing some work in the home of the alleged victim. After he left with his co-worker, the home owner called the police to report an Ipad missing. Due to a lack of discovery, it is impossible to determine what exactly transpired next but at some point, a picture of a penis was found on a digital camera. The camera may have belonged to the home owner’s daughter but that remains unclear. Regardless, the possible connection between the camera and the daughter led to the endangering the welfare of a child charge. Although there is no indication that the co-worker implicated my client, my client was arrested after the police spoke to the co-worker. The co-worker was never arrested.
The client swore up and down that it wasn’t him but I was unable to determine why the client was charged and the co-worker was not. It took us quite some time to get the discovery from the State but we eventually did before the client was indicted. Obtaining pre-indictment discovery is always important and it is often overlooked by defense lawyers in New Jersey. The discovery raised more questions and answered none. There was absolutely no evidence against my client! I mean none, zero, zilch. In fact, there was no discovery about much of anything. Luckily, I was dealing with a great prosecutor. I explained to her that she didn’t have a case against my client or anyone. As a result, I was able to get all of the felony charges dismissed.

Client avoids jail time in Ocean County violation of restraining order case
We worked out another great deal today. In this case, our client was facing two contempt charges for violating a restraining order. In the first case, he went to the victim’s house after he was verbally advised of the restraining order. He was then arrested. The next day he texted the victim several times which then resulted in yet another violation of the restraining order and thus, yet another arrest. The big concern here is that he had a criminal record and was thus looking at six months in jail if convicted.
Luckily, the client hired our team of tough, smart, Ocean County Criminal Defense Lawyers to help him. We were able to get one of the charges dismissed and make sure that he didn’t spent one day in jail. Other than $125 fine, he will suffer no real consequences as a result of the plea.

Responding to an Adult Protective Services Investigation in New Jersey
In New Jersey, Adult Protective Services (also known as APS) investigates abuse, neglect or financial exploitation of vulnerable adults. Vulnerable adults include the elderly, mentally handicapped and others. Adult Protective Services works closely with police to investigate these claims. On their own, APS can work to remove the adult from the home on a temporary basis until the matter proceeds to court. This can be done regardless of police involvement. However, the concern is that admissions made in the court case can lead to evidence that the police can use to prosecute for elder abuse, assault, theft or fraud.
Likewise, the police can arrest and prosecute for elder abuse, assault, theft or fraud regardless of what APS does. However, evidence gathered by APS including statements taken by the accused, will be key pieces of evidence in the prosecution of the case.
Thus, if you even think that you may be the target of an Adult Protective Services investigation, you should call a lawyer right away. Anything you say or do can be used against you. Call us anytime to discuss your case and see how we can help you.

Newark Airport Security Guard Uses Stolen Identity For 20 Years
The Newark airport security guard is being held in place of a $250,000 bail for identity theft. Authorities have no clue as to who the individual really is, so it makes sense that the judge would deny bail. Not only would there be a flight risk, but who are they holding?
