Teen questioned in connection with attack on serviceman

A 16-year-old Seaside Heights boy was questioned about the assault of a 28-year-old serviceman from Newport News, Va.   Police were dispatched at 12:59 a.m. Sunday  after calls began pouring in that a man was lying face down on the ground.  Police found a manect bleeding, and near him were three other individuals, a male and two females.  The victim was unconscious for a period of time and was incoherent when he did regain consciousness  First Aid treated him at the scene he was transported to the trauma unit at Jersey Shore University Medical Center in Neptune.

Investigators were told an argument ensued in Seaside Heights but that it ended three blocks away in Seaside Park.  While the three unnamed witnesses say the 16-year-old threw the first punch and ultimately beat victim unconscious, officials said the teen claims the serviceman taunted him and grabbed him by the throat.
The 16-year-old was interviewed with a parent present and subsequently processed at the Ocean County Juvenile Detention Center in Toms River.

Jersey City Man Sentenced for Distributing Child Pornography Over the Internet

Nicholas Castrovinci, of Jersey City, was sentenced to 5 years in prison by Superior Court Judge Paul DePascale in Hudson County. He pleaded guilty on April 30 to second-degree endangering the welfare of a child/distribution of child pornography. He will not be permitted to access the Internet for the duration of his sentence, and he will be required to register as a sex offender under Megan’s Law.  An investigation by the New Jersey State Police determined that on June 30, 2009, Castrovinci knowingly used Internet file sharing software to make multiple files containing child pornography readily available for anyone else to download from a  “shared folder” on his computer. A State Police detective was conducting an undercover investigation into the possession and distribution of child pornography on the Internet via peer-to-peer software, when he downloaded two video files that contained child pornography from the shared folder on the computer.  He was arrested on July 31, 2009. A search warrant executed on that date revealed numerous videos containing child pornography on the computer.

Megan’s Law was enacted in 1994.  Under New Jersey law, after fifteen (15) years, sex offenders can move to terminate the obligation to register under Megan’s Law.  Those under community supervision for life can also file a motion.  In either case, they need to show no subsequent convictions and that they are no longer a threat to others.  The Public Defender’s office is not allowed to file these motions so a private attorney must be hired to file these motions with the court.

Megan’s Law Crimes in New Jersey 

Megan’s Law applies if a criminal defendant is convicted, adjudicated delinquent, or found not guilty by reason of insanity to any of the following criminal offenses or an attempt to commit any of the following:

  • Aggravated Sexual Assault
  • Sexual Assault
  • Aggravated Criminal Sexual Contact
  • Kidnapping (where the victim is less than sixteen (16) years old)
  • Endangering the Welfare of a Minor by Engaging in Sexual Contact with a Minor
  • Endangering the Welfare of a Minor by knowingly receiving for the purpose of selling, knowingly sells, procures, manufactures, gives, provides etc. through any means (including the internet) any photos, films, videos, etc. which depict a child engaging in a prohibited sexual act or in the simulation of such an act
  • Luring or Enticing a Minor
  • Criminal Sexual Contact (if the victim is under the age of eighteen (18))
  • Kidnapping (where the victim is under 18 and the offender is not the parent)
  • Criminal Restraint (where the victim is under 18 and the offender is not the parent)
  • False Imprisonment (where the victim is under 18 and the offender is not the parent)

Community Supervision for Life in New Jersey

If the offender was convicted for any of the following offenses and the offense occurred after October 31, 1994 (when Megan’s Law became effective) but before January 14, 2004, then Community Supervision for life will apply (after that date, Parole Supervision for life applies):

  • Aggravated Sexual Assault
  • Sexual Assault
  • Aggravated Criminal Sexual Contact
  • Kidnapping (N.J.S.A. 2C:13-1(c)(2) ONLY)

Atlantic City Police Arrest 25 in Prostitution Sweep

Atlantic City police arrested 25 people in a prostitution sweep on Pacific Avenue on Friday.   The sweep was conducte by the Atlantic City Police Department’s Special Investigations Section along with members of the Atlantic County Prosecutor’s Office and Sheriff’s Department.  23 women and one man were charged with engaging in prostitution, including Atlantic City’s Ryan Brinson, 27; Simone M. Mason, 22; Zakysha J. Jones, 23; Karim F. Donaldson, 28; and Jade Alexander, 24; Samantha Bowe, 19, of Pleasantville; Nyrie Emslie, 25, and Stacy Sarokas, 30, of Mays Landing; and Deborah Shaul, 51, of Mullica Township.

Another woman, Latasha Brown, 22, of Somers Point, was charged with promoting prostitution.  There was no information regarding how the investigation was conducted or what the evidence the State has.  While I have won these cases before, they can be tough, especially in Atlantic City where the State does not really offer plea bargains for criminal cases.  Thus, most of these defendants will have to plea out to the criminal charge or go to trial.

Barnegat man charged with growing marijuana

Donovan Wainwright has been arrested on drug possession charges after 25 marijuana plants were found at his Ridegway Street home.  He was charged with fourth-degree possession of a prescription drugs, fourth-degree possession of less than one ounce of marijuana, possession of marijuana under 50 grams and possession of drug paraphernalia.  Police say that six of the plants were approximately two feet tall, while the remaining 19 were approximately a foot tall.

Point Pleasant Beach man charged in hit-and-run of teen girl

Jeffrey Garabadian, 35, of St. Louis Avenue, was arrested at his home and charged with knowingly leaving the scene of an accident that caused serious bodily injury.  Point Pleasant police and the Ocean County Prosecutor’s Office discovered Garabadian’s 1998 dark green Jeep at his home after an investigation.  Around 10:45 p.m. Tuesday, according to police, Garabadian was backing his Jeep out of a Citgo service station when he struck a 14-year-old girl and drove away. The teen is currently listed in critical but stable condition and her identity has not been released.

Charges filed in crash that killed Manchester mother

Jean Paul Forde of Martin Drive in the Whiting section of Manchester, faces charges of death by auto and assault by auto for the May 30 collision that killed Colleen Guierro of Second Avenue in Manchester, according to Jackson police Capt. David Newman.  Forde was allegedly driving at a high rate of speed while under the influence of alcohol, when he lost control of a 1998 Honda Accord and crashed into the 2007 Chevrolet Cobalt driven by Colleen Guierro, who was pronounced dead at the scene. Forde is charged with vehicular homicide, assault by auto, driving while intoxicated, reckless driving and failure to maintain a lane.

Staten Island Man Faces Charges After Allegedly Trying to Run Over Girlfriend

Douglas Parsley, of Staten Island, was charged with aggravated assault, endangering the welfare of a child, drunken driving and multiple motor vehicle violations.  He allegedly got into an argument in front of a gas station on Route 35 with his girlfriend, Tammy Robinson,  also of Staten Island, over whether he was too intoxicated to drive.   He then allegedly attempted to run over Robinson while she was standing with her 8-year-old daughter and the girl’s 6-year-old friend.  When officers arrived, Parsley had fled in his blue Infiniti.  Several minutes later, other officers attempted to pull the car over, but Parsley allegedly failed to stop for the officers and was eventually apprehended at a cul-de-sac in Hazlet.

Hazlet police assisted and charged Parsley with eluding and criminal mischief.

Possession of fireworks in New Jersey is a Crime

The New Jersey Attorney General has reminded the public that fireworks are illegal in New Jersey and that police will be cracking down on anyone who is found in possession of fireworks.  In addition, State Police will be watching for people who are driving to Pennsylvania to buy fireworks to bring back to New Jersey.  How they actually plan to do this is unknown.

Possession of fireworks in New Jersey is a disorderly persons offense which means that jail time is possible and you will have a criminal record if convicted.  Possession of fireworks with the intent to sell is a fourth-degree offense with a possible maximum penalty of 18 months imprisonment and fines up to $10,000.  If you are  charged with possession of fireworks in any court in New Jersey, you should call an attorney right away.  I can be reached at anytime.
